The U.S. Senate is approaching a decisive test for the Clarity Act, a sweeping digital-asset market structure bill that could reshape how cryptocurrencies are regulated in the United States. A procedural vote scheduled for September 15 will determine whether the chamber can move toward final consideration after months of negotiations over ethics, stablecoin rewards and regulatory jurisdiction.

President Donald Trump has accepted significant new ethics restrictions intended to win Democratic support, but the legislation still faces resistance from lawmakers and banking groups. The outcome could determine whether Congress establishes a durable statutory framework for digital assets this year or leaves regulators to keep building rules through existing agency powers.

Clarity Act Reaches a Critical Senate Test

The Clarity Act, formally H.R. 3633, is designed to create a comprehensive federal market structure for digital assets. The measure passed the House by a bipartisan 294–134 vote in July 2025 and would establish clearer regulatory responsibilities for different types of crypto assets and market intermediaries.

The Senate Banking Committee advanced the legislation 15–9 in May 2026, but negotiations continued throughout the summer. Tuesday’s cloture vote requires 60 votes to end debate and allow the Senate to proceed toward further consideration.

Republicans released revised text ahead of the critical vote containing numerous changes sought by Democrats. The negotiations have focused on ethics, consumer safeguards, financial stability and whether the bill adequately prevents public officials from benefiting from crypto ventures while in office.

Trump Ethics Concessions Shift the Debate

Ethics provisions have become one of the legislation’s biggest obstacles because Trump and members of his family have substantial ties to crypto businesses.

The latest compromise incorporates major elements of a proposal negotiated by Republican Sen. Thom Tillis and Democratic Sen. Ruben Gallego. Trump accepted provisions that include stronger restrictions around significant crypto interests and expanded enforcement powers for state attorneys general alongside federal authorities.

That enforcement power had been an important Democratic demand because it reduces reliance on the Justice Department alone when potential conflicts involve federal officials. However, some Democrats continue to argue that the revised safeguards remain insufficient, leaving the final vote count uncertain.

Stablecoin Rewards Remain a Banking Flashpoint

The second major dispute concerns stablecoin rewards. Banking groups argue that crypto platforms can structure incentives that operate like interest on deposits, encouraging customers to move money from bank accounts into stablecoins.

The revised bill responds with a regulatory circuit breaker. It establishes an 18-month deposit-flight review mechanism under which Treasury would assess whether stablecoin incentives have caused substantial harmful deposit flight from community banks and could then trigger restrictions.

Banking associations say that approach reacts too late. They want clearer restrictions on interest-like stablecoin rewards before deposit losses occur, arguing that lower bank deposits could reduce funding available for mortgages, small-business loans, agricultural credit and other local lending.

This dispute has turned the Clarity Act into more than a fight over cryptocurrency rules. It is also a debate about whether payment stablecoins could evolve into direct competitors for traditional bank deposits.

What the Bill Could Change

At its core, the legislation seeks to replace years of uncertainty with a clearer statutory division of responsibility. The proposed framework would establish a clearer jurisdictional line between federal regulators, preserving securities oversight where appropriate while giving the CFTC clearer authority over digital commodities and centralized intermediaries operating in those markets.

Federal regulators have already moved toward greater clarity without waiting for Congress. In March, the SEC and CFTC issued a coordinated interpretation of crypto-asset rules explaining how federal securities laws apply to several categories of digital assets.

The SEC followed in August with proposed tailored crypto offering rules for certain investment contracts involving crypto assets. That means failure in the Senate would not stop U.S. crypto regulation, although legislation could create a more durable framework that future administrations would have greater difficulty reversing.

Why the September 15 Vote Matters

Tuesday’s vote is procedural rather than final passage, but it is a major test of whether a bipartisan coalition still exists. Clearing cloture would keep the bill alive for amendments, further debate and an eventual final vote.

Failure would leave supporters with limited time to rebuild support before the current Congress ends and could shift more responsibility for crypto policy toward federal regulators.

For the crypto industry, the vote is an opportunity to secure long-sought statutory rules. For banks and skeptical lawmakers, it is leverage to demand stronger protections. The Clarity Act therefore enters its Senate test as a broader contest over digital finance, political ethics and the future relationship between crypto and traditional banking.
